Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the Fact Engineering website, applications, and API (together, the “Service”), operated by Fact Engineering Inc., a Delaware corporation (“Fact Engineering”, “we”, “us”). By creating an account or using the Service you agree to these Terms.

1. The Service

Fact Engineering is an AI-assisted fact-checking service. You submit text or documents and the Service analyses them across one or more checking tiers — spelling and grammar, verification against AI model knowledge, and verification against live internet research — using a panel of AI models from multiple providers whose outputs are synthesized into consensus verdicts.

We continuously improve the Service and may add, change, or remove features, including the specific AI models and search providers used, at any time.

2. Eligibility and accounts

You must be at least 18 years old (or the age of majority where you live) and capable of entering into a binding contract to use the Service. You are responsible for your account: keep your credentials and API keys confidential, provide accurate information, and let us know promptly at support@fact.engineering if you suspect unauthorized use. Activity that occurs under your account or API keys is your responsibility.

3. Credits and payment

The Service is prepaid: you purchase credits, and each check consumes credits based on its tier, the number of claims detected, and the model panel you select. The full credit price of a check is shown before you start it, and that is the price you pay.

  • Payments are processed by Stripe. We do not store your card details.
  • Credits do not expire.
  • If a check fails to complete, its credits are automatically refunded to your balance.
  • Purchased credits are otherwise non-refundable, except where a refund is required by applicable law or where we terminate your account or discontinue the Service without cause, in which case we will refund your unused purchased credits.
  • We may change credit pricing prospectively; changes never affect credits you already hold or checks already started.

4. Your content

You retain all rights to the documents and text you submit and to the material in your Knowledge Bank (“Your Content”). You grant us a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to provide and secure the Service — including sending relevant excerpts to the AI model and search providers that perform the checks you request.

We do not use Your Content to train AI models.

You are responsible for Your Content, including having the rights needed to submit it and ensuring it does not violate the law or these Terms.

5. AI-generated results

Fact-check verdicts, confidence scores, citations, and suggested corrections are generated by AI models. They reflect model consensus, not established truth, and may be inaccurate, incomplete, or out of date — citations may mischaracterize their sources. Results are provided for your evaluation only; they are not legal, medical, financial, or other professional advice, and you remain solely responsible for decisions you make and content you publish based on them.

6. Acceptable use

You agree not to:

  • use the Service for unlawful purposes or submit content you have no right to submit;
  • probe, disrupt, or overload the Service, or circumvent rate limits, credit metering, or security measures;
  • reverse engineer the Service or use it to build a competing fact-checking service;
  • resell or share access to the Service or your API keys without our written consent;
  • misrepresent AI-generated results as an independent human certification or endorsement by Fact Engineering.

7. API and webhooks

Use of the API is subject to these Terms and any published rate limits. Webhook deliveries are signed; you are responsible for verifying signatures and for the security of your receiving endpoints. If you connect third-party services or bring your own provider API keys (Connectors), your use of those services is also governed by the third party's own terms, and you are responsible for the keys you supply.

8. Intellectual property

The Service — including its software, design, and branding — is owned by Fact Engineering Inc. and its licensors, and is protected by intellectual-property laws. Apart from the rights expressly granted in these Terms, no rights in the Service are transferred to you. If you send us feedback, we may use it without restriction or compensation.

9. Termination

You can stop using the Service at any time and request deletion of your account and data as described in our Privacy Policy. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. Upon termination, your right to use the Service ends; Sections 4–5 and 8–12 survive.

10. Disclaimers

The Service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that fact-check results will be accurate, complete, or reliable.

11. Limitation of liability

To the fullest extent permitted by law, Fact Engineering Inc. will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from your use of the Service. Our total liability for all claims relating to the Service is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law — including, for consumers in the European Union or European Economic Area, liability for intent, gross negligence, or death or personal injury.

12. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, excluding its conflict-of-law rules. If you are a consumer residing in the European Union or European Economic Area, you additionally benefit from any mandatory provisions of the consumer-protection law of your country of residence, and you may bring proceedings in the courts of that country. Nothing in this section deprives you of protections that cannot be waived by contract.

13. Changes to these Terms

We may update these Terms from time to time. For material changes we will give reasonable advance notice — for example by email or an in-product notice. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
